Conditions and Consents of Entry and Risk Waiver

By entering to participate in the Walk for Kids With Cancer Event (Event), you acknowledge you have read and understood, and agree to, all the following terms.  

Your agreement to these terms forms a binding agreement between you (the Participant, you) and the Sydney Children’s Hospitals Foundation Limited ACN 003 073 185 (SHCF) and all rights, releases and indemnities provided by you in these terms cover SCHF’s related bodies corporate, directors, employees, contractors, and volunteers, as well as any Event sponsors and any council bodies, owners and licensees of land upon which the Event is conducted.

Walk for Kids With Cancer event (Event) is run by Sydney Children's Hospitals Foundation, its employees, agents, volunteers and contractors (together 'Sydney Children's Hospitals Foundation' and known as 'Indemnified Parties').

SCHF may amend these terms prior to the Event by written notice to you, and your continued participation in the Event will constitute your deemed acceptance of the terms as amended.  

Conditions of Entry

  1. Submission: You must submit your entry through the official online system. The number of competitors will be strictly limited and will be decided on the basis of first received or until registrations close. You may not substitute yourself for any other person to participate on your behalf. If your contact details change after your registration is completed, you must notify SCHF by updating your details in the official online system.

  2. Participant’s Age: You represent and warrant that you are 18 years or older, or that you are the parent/legal guardian of the Participant who is under the age of 18 years. As a parent or legal guardian, you agree to these terms and conditions for and on behalf of the Participant. 

  3. Entry Fee: Your participation in the Event is not approved unless and until you pay the entry fee through the official online system. The entry fee is only refundable in the limited circumstances specifically stated in these terms.  

  4. Changes to Event Details: SCHF reserves the right to change or modify any part of the Event including the date, course and location at any time and from time to time. Details of any such changes will be published via the Event website, and we may also communicate these changes to you through SMS, our Facebook page or other means. 

  5. Promotional Codes: You may only use a promotional code where you meet the conditions applying to the code and where you use it within the validity period. Promotional codes are not able to be redeemed or exchanged for cash and must only be used by the person to whom the relevant code was issued to by the code owner. SCHF reserves the right to modify, suspend and/or cancel any promotional code at any time without notice to you. No refunds will be given is you have access to a promotional code but did not use the code at the time of purchase. 

  6. Stay on Course: You must follow the approved course, observe normal traffic rules and obey all directions and instructions given by Event officials and the police. 

  7. Race Bibs: You must wear the official chest bib corresponding to the registration made in your name on your chest such that the allotted race number and sponsor names can be seen for the duration of the Event. A timing tag is attached to the back of the race bib to enable your walk to be timed. You must not tamper with the timing tag attached to your race bib. SCHF takes no responsibility for errors or omissions in the timing data. By participating in the Event and wearing the race bib, you consent to SCHF (and any subcontracted third party provider) collecting and publishing your timing data for the Event. You understand that starting the race before your assigned wave start time will result in disqualification. 

  8. No Other Accessories: No roller skates, roller blades, hand cycles, geared vehicles, skateboards, bicycles, scooters, prams/strollers and dogs (other than service dogs) or other accessories that may cause injury will be permitted.  

  9. Non-Completion of Event: SCHF reserves the right, in its discretion, to reject or cancel your entry at any time, including without limitation for safety or insurance reasons, or if, in the opinion of SCHF, you are unable to complete the Event within the cut-off times. SCHF will not refund any portion of the entry fee in such circumstances. 

  10. Denial of Participation: You may be removed from the Event if, in SCHF’s sole discretion (a) your behaviour is inappropriate, offensive, or abusive, (b) to prevent damage to any property, (c) on medical or health and safety grounds (including to prevent possible harm or injury to yourself and/or any other person), or (d) to prevent or arrest any form of unauthorised marketing, including ambush marketing. SCHF will not refund any portion of the entry fee in such circumstances. 

  11. SCHF Cancellation of Event: SCHF reserves the right to cancel the Event at any time, by written notice to you, in which case any entry fees paid to SCHF will be refunded to you. However, no other costs or expenses incurred by you in anticipation of the Event will be refunded (including any travel, accommodation, or clothing expenses). 

  12. Emergency Contact: You must write an emergency contact name and phone number in the space provided on your supplied race bib and SCHF may contact that person and exchange your information, and details of your injury, with them in case of an emergency. If our on-site first aid staff deem, in their discretion, that an ambulance is required, we will call an ambulance for you at your cost.  

Consents

  1. Privacy Consent: SCHF collects your personal information for the administration of the Event, for emergency purposes during the Event, and for future marketing and promotional purposes. You consent to SCHF using your personal details for the administration of the Event, including to SMS Event information to you. You consent to your personal details being used by SCHF for future marketing and promotional purposes.  

  2. Imagery Consent: You consent to the publication and/or use in any form of media whatsoever of your name, race result, image, voice, statement or otherwise, (including the publication of your name and/or Event result, suburb and applicable age bracket in any SCHF publication and/or on the Event website) without payment or compensation. 

Risk Waiver

  1. Physical Fitness: You are not aware of any illness, injury, physical disability or impairment which may limit or otherwise effect your ability to safely participate in the Event without causing injury or death to yourself or any other participant.  

  2. Inherent and unavoidable risks of injury and death: You acknowledge that there are inherent and unavoidable risks of participating in an event of this nature, including through natural hazards such as weather events, and through being in public such as vehicle collisions, altercations with other persons, and the transmission of airborne illnesses. You acknowledge that specific risks to your health may include (but are not limited to): sprained joints, tendon rupture, ligament tear, broken bone, paraplegia, quadriplegia, graze and skin loss, heart attack, cardiac arrest, seizure, aneurysm and contraction of COVID-19 or other viruses, which may require medical treatment, hospitalisation, chronic or permanent personal care assistance, and institutionalisation (at your sole expense).  

  3. Release and Indemnity: You hereby release, indemnify and discharge SCHF from all and every claim, right or cause of action (including for negligence, for breach of contract or breach of statute) for which you might have, or but for this waiver would have had, arising out of your participation in the Event, including where any of the risks outlined in clause 16 arise.
